Van Lindberg practices intellectual property law, including patent, trademark, copyright, and trade secret law. He has experience with both computer hardware and software, including digital circuit design, operating system design and implementation, application programming, and networked and distributed systems. Mr. Lindberg also has experience with virtualization, wireless networking, high-availability web-based systems and programming languages.

Mr. Lindberg has particular expertise in the Open Source licensing model. He helps analyze the risks and benefits of using and creating Open Source software and advises on compliance with Open Source licenses.

Before joining Haynes and Boone, Mr. Lindberg was a research and development engineer at a multinational telecom and IP (Internet Protocol) services provider.

  • Prepare reexamination requests and advise on the use of patent reexamination in high-stakes litigation

  • Analyze multiple patent portfolios comprising thousands of patents; advise senior in-house intellectual property counsel concerning strategic coverage, claim strength, and patent value

  • Prepare patent applications and Office Action responses in the computer arts

  • Provide intellectual property advice and patent prosecution services to early-stage startups

  • Advise open source groups on intellectual property concerns

04/01/2009 - Patent Reexamination: Letting Open Source Companies Play Offense
The patent system provides unique challenges for companies that use open source software. While business pressures and shareholder expectations generally favor strong patent protection and substantial use of the patent system to create business value, the open source community can be hostile to the patent system in general and software patents in particular. Patent reexamination includes a number of legal and cost benefits that can make it a valuable tool for open source companies that compete in patent-heavy industries.
